Faithero provides Bible text and faith-based content for personal devotional and educational use. It is NOT a substitute for professional medical, legal, financial, or mental-health advice, or for guidance from a qualified religious leader. AI-generated responses may be inaccurate and do not represent official doctrine of any church or denomination.

These terms constitute a binding agreement between you and NGSMedia LLC ("we," "us," or "our") governing your use of the Faithero mobile application and related services (the "App").

Your use of Faithero is also governed by our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, please do not use Faithero.

1. Age Requirement

Faithero is intended for a general audience. Users under 18 years of age must have parental or legal guardian consent to use the App and to make any purchases.

2. Changes to Terms

We may update these Terms at any time. When we make changes, the new Terms will be made available in the App with an updated effective date. Your continued use of Faithero after changes take effect means you accept the new Terms.

3. License

NGSMedia LLC owns all rights to Faithero and its content, excluding content you create and third-party content licensed to us. We grant you a limited, non-exclusive, non-transferable, revocable license to download and use Faithero on your personal devices for personal, non-commercial use. You may not modify, sell, distribute, reverse-engineer, or create derivative works from the App without our prior written permission.

4. Scripture & Content

Bible translations and other content are provided for personal, non-commercial devotional and study use under their respective licenses. Some translations are protected by copyright owned by their publishers. You may not redistribute, resell, or use this content outside the App except as permitted by the applicable license.

5. Not Professional Advice

You acknowledge and agree that:

Faithero provides inspirational and educational content, NOT professional advice of any kind
AI-generated responses are automated, may be inaccurate or incomplete, and do not represent authoritative religious teaching
For medical, legal, financial, or mental-health concerns, consult a qualified professional
If you are in crisis or may harm yourself or others, contact local emergency services or a crisis line immediately

6. Intended Use

Faithero is designed for personal devotional reading, study, and reflection. It is NOT intended for any unlawful purpose or to infringe the rights of others.

7. User Conduct

You agree NOT to:

Use the App for any unlawful purpose or in violation of any applicable laws
Attempt to generate hateful, harassing, or otherwise harmful content with the AI features
Attempt to hack, modify, reverse-engineer, or interfere with the App
Redistribute the App's content or use it for commercial purposes without our written permission

8. AI & Automated Features Disclaimer

Faithero includes AI features that run on an on-device model. You acknowledge and agree that:

Responses are generated automatically and are NOT guaranteed to be accurate, complete, or doctrinally correct
AI output should not be treated as authoritative teaching or professional advice
These features are provided "AS-IS" without any warranty of accuracy or fitness for any purpose

9. Purchases & Subscriptions

Subscriptions are processed through the Apple App Store on iPhone and iPad, and through Google Play on Android
Subscription terms and pricing are displayed before purchase
Subscriptions automatically renew unless cancelled before the end of the current period (on the Apple App Store, at least 24 hours before it ends)
You can manage and cancel subscriptions through your device's account settings on iPhone and iPad, and through Google Play on Android
Refunds are handled according to the policies of the Apple App Store or Google Play, whichever you subscribed through
We do not directly process payments or have access to your payment information

10. Third-Party Services

Faithero uses third-party services including Apple/Google authentication, Cloudflare for account management, and Apple's App Store and Google Play for subscription processing. These services have their own terms and privacy policies. We are not responsible for the practices of these third parties.

11. Disclaimers & Limitation of Liability

No Warranties

FAITHERO IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will be available, uninterrupted, secure, or error-free, that content or AI output will be accurate or reliable, that defects will be corrected, or that the App will meet your specific requirements.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NGSMEDIA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless NGSMedia LLC and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the App, your reliance on any content or AI output, your violation of these Terms or any applicable law, or your violation of any third party's rights.

13. Dispute Resolution

Arbitration Agreement

Any disputes arising from or relating to these Terms or your use of Faithero shall be resolved through binding individual arbitration rather than in court, except that you may assert claims in small claims court if eligible. Disputes are resolved individually, NOT as class actions, and an arbitrator (not a judge or jury) will decide the dispute.

Class Action Waiver

YOU AND NGSMEDIA LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

How to Start Dispute Resolution

Before initiating arbitration, you must first contact us at support@faithero.com to attempt informal resolution. If we cannot resolve the dispute within 60 days, either party may initiate binding arbitration through the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

14. General Terms

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NGSMedia LLC regarding your use of Faithero and supersede all prior agreements.

Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
